Understanding the Current Status of Ozempic Litigation
Federal Ozempic and GLP-1 lawsuits involving gastrointestinal injuries are consolidated in MDL No. 3094, In re: Glucagon-Like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, before Judge Karen S. Marston in the U.S. District Court for the Eastern District of Pennsylvania.
As of mid-2026, the MDL included nearly 3,850 pending cases. It has been one of the fastest-growing pharmaceutical mass torts in the country since it was formed in February 2024.
The litigation is still in a pretrial phase. Judge Marston declined to dismiss most claims against Novo Nordisk and Eli Lilly in August 2025. The parties are currently litigating key legal questions about warning adequacy and preemption.
